Court of Appeals Grants Kramon & Graham Certiorari Petition

The Court of Appeals of Maryland has granted a petition for a writ of certiorari filed by Kramon & Graham, P.A. principals David J. Shuster and Ezra S. Gollogly. Among the issues that the Court of Appeals will address is a novel question of law involving the interplay between the federal bankruptcy statute and Maryland's joint tortfeasor statute. Specifically, the court will address whether the Maryland Uniform Contribution Among Joint Tort-Feasors Act, Md. Code Ann., Cts. & Jud. Proc. §§ 3-1401, et seq., applies to claims filed by asbestos-injury plaintiffs in both the civil judicial system against non-bankrupt defendants and against bankrupt defendants under § 524 of the U.S. Bankruptcy Code. The case has potentially significant implications for asbestos-related litigation in Maryland.
