Fourth Circuit's decision affirms Kramon & Graham client victory in strict products liability case

Summer NiazyJohn BourgeoisKramon & Graham trial attorneys John Bourgeois and Summer Niazy obtained a victory on behalf of their client, the plaintiff, in a products liability lawsuit in the U. S. District Court for the District of Maryland. The defendants were found liable for strict products liability and breach of warranty for distributing a contaminated medical product for use in transplant tissue recovery procedures. Thankfully, no injuries were caused through use of the contaminated product, though significant economic loss was incurred by the client. The trial court awarded our client 100% of its losses, plus interest. The defendants appealed the judgment to the U.S. Court of Appeals for the Fourth Circuit, which affirmed the district court's decision in an opinion published February 15, 2023.
