Asset Recovery and Creditors' Rights

Obtaining a money judgment against an adversary is, many times, only half of the battle. Enforcing, and ultimately collecting, a judgment can be the most challenging aspect of civil litigation, especially when debtors fraudulently transfer or attempt to conceal their assets. 
 
As a result of our superb reputation as accomplished trial attorneys, we are frequently called upon to represent creditors in their most arduous and sophisticated collection matters. Bankruptcy trustees, the Securities Commissioner for the State of Maryland, and court-appointed receivers have hired the Firm to serve as special litigation counsel in complicated asset recovery proceedings. 
 
Kevin F. Arthur and David J. Shuster, two of the Firm's principals, have extensive experience in these matters. In addition to aggressively and effectively representing clients in fraudulent conveyance, preference, and traditional collection claims, Mr. Arthur and Mr. Shuster have had considerable tactical success in adversary proceedings employing the doctrine of "continuing concealment" – a doctrine of bankruptcy law that, to the disappointment of debtors, is gaining nationwide judicial acceptance. The Firm's aggressive collection efforts have resulted in the recovery of millions of dollars for the Firm's clients.
