Fourth Circuit Affirms Two Victories for Mortgage Lenders

The United States Court of Appeals for the Fourth Circuit affirmed two wins obtained by Andrew Jay Graham and John A. Bourgeois in two published opinions.  On July 10, 2014, in Petry v. Prosperity Mortgage Company, a unanimous panel of the Circuit Court affirmed the trial court's dismissal on the eve of trial of a class action against the firm's client, Wells Fargo, and others, alleging violations of the Maryland Finder's Fee Act.  Click here for a copy of the decision.  On August 5, 2014, in Minter v. Wells Fargo Bank, N.A., the same unanimous panel affirmed a jury's verdict in favor of Wells Fargo and others in a separate class action alleging violations of the federal Real Estate Settlement Procedures Act.  Click here for a copy of the Minter opinion.
